December Wawa Zoning Hearing Board Meeting Information

The Zoning Hearing Board will be meeting on Thursday, December 14 at 7 PM. PLEASE NOTE:This meeting will be held in the Council Room at Borough Hall, 414 S. York Rd., Hatboro.

The board will continue hearing the application of Buckingham Retail Properties, LLC for the properties located at 402 & 412 S. York Road (RC-2 Zoning District) and 29 Horsham Road (R-1 Zoning District) requesting zoning relief to permit a convenience store with motor vehicle fuel sales, as follows:

1) A substantive validity challenge to the zoning ordinance based on a de jure exclusion of retail stores with motor vehicle fuel sales; Or in the alternative

A substantive validity challenge to the zoning ordinance based on a de facto exclusion of retail stores with accessory motor vehicle fuel sales; Or in the alternative

A variance from Section 27-602 and Section 27-1202.M "Use Regulations" to permit improvements associated with a retail store use in the R-1 Zoning District, and to permit an accessory use, motor vehicle fuel sales, not to be located at or above the second-story level; Or in the alternative

A variance from sections 27-602 and 27-1202 "Use Regulations" to permit a retail store with motor vehicle fuel sales in the RC-2 and R-1 Zoning Districts.

2) A variance from section 27-1205.1.F "Development Regulations for Retail Commercial Uses" to permit a permanent landscaped planting area of less than 15' in depth adjacent to an office use.

The public is invited to attend and will be given an opportunity to comment. The application and plans are available for review at Borough Hall, 414 S. York Road, Hatboro, Monday through Friday during regular business hours.
